1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of AgCert (“the Service”), operated by Bluegrass Pastoral Pty Ltd (“we”, “us”, “our”). By creating an account, accessing, or using AgCert, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

AgCert is a farm compliance record-keeping application for Australian livestock and mixed-farming operations. The Service provides:

  • LPA and MLA record-keeping across all record modules (treatments, spray, pasture, grain & fodder, feeding, dispatch, movements, visitors, rainfall);
  • Livestock treatment withholding period (WHP) and export slaughter interval (ESI) lookup and tracking;
  • Active WHP dashboard alerts;
  • AI-assisted product label scanning (batch number and expiry extraction);
  • CSV and PDF compliance report generation;
  • Multi-property and paddock management.

AgCert is a record-keeping and reference tool. It does not provide agronomic, veterinary, legal, or other professional advice.

3. Eligibility

You must be at least 18 years of age and capable of forming a legally binding contract to use AgCert. By using the Service you represent that you meet these requirements and that the information you provide is accurate and current.

4. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised use. We may suspend or terminate accounts that breach these Terms.

5. Free Trial

AgCert may be offered with a free trial period. At the end of the trial, continued access requires a paid subscription. We may modify, limit, or withdraw trial availability at any time.

6. Subscriptions and Billing

Paid subscriptions are billed in advance on a recurring basis through our payment provider. Subscriptions renew automatically unless cancelled before the renewal date. Fees are stated in Australian dollars and include GST where applicable. You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

7. Your Records and Data

The farm records and data you enter remain your property. You grant us a limited licence to store and process that data solely to operate and provide the Service. You are responsible for the accuracy and completeness of the records you enter. Our handling of personal information is described in our Privacy Policy.

8. Acceptable Use

You agree not to misuse the Service, including by attempting to gain unauthorised access, interfering with its normal operation, uploading unlawful or infringing content, or using it in breach of any applicable law or the requirements of the Livestock Production Assurance (LPA) program.

9. Third-Party Services

AgCert relies on third-party providers to deliver its features, including WillyWeather and Open-Meteo (weather data), Stripe (payment processing), Supabase (database and authentication hosting), Anthropic (AI label reading), and Vercel (application hosting). Your use of the Service may be subject to those providers’ terms. We are not responsible for the acts, omissions, or availability of third-party services.

10. Intellectual Property

AgCert, including its software, design, branding, and the “Developed by Farmers for Farmers” trademark, is owned by Bluegrass Pastoral Pty Ltd and protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as intended.

11. Compliance Disclaimer

AgCert assists with record-keeping to support Livestock Production Assurance (LPA) and Meat & Livestock Australia (MLA) requirements. It does not guarantee compliance. Withholding period (WHP), export slaughter interval (ESI), weather, and AI-extracted data are provided as a guide only and must be verified against current product labels and official sources. You remain solely responsible for meeting your compliance obligations.

12. Warranties and Consumer Guarantees

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all implied warranties. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Where our liability for a failure to comply with an ACL guarantee can be limited, it is limited, at our option, to resupplying the Service or paying the cost of resupply.

13. Limitation of Liability

To the maximum extent permitted by law, Bluegrass Pastoral Pty Ltd will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from reliance on WHP or ESI data, AI label-reading results, weather data, or any record generated by the Service. Our total liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months preceding the claim.

14. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or where necessary to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.

15. Changes and Governing Law

We may update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance of the updated Terms. These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
